1. About these terms

These terms and conditions ("Terms") govern your use of the MotorMafia website and any purchase you make from us. The website and business are operated by Fibaro Pty Ltd (ABN 50 600 361 822) trading as MotorMafia ("MotorMafia", "we", "us", "our").

By using the website or placing an order, you agree to these Terms. If you do not agree, please do not use the website. We may update these Terms from time to time, and the version in effect when you place an order applies to that order.

2. Eligibility

You must be at least 18 years old and able to enter into a legally binding contract to purchase from us. If you order on behalf of a business, you warrant that you are authorised to bind that business to these Terms.

3. Products, descriptions & fitment

We aim to describe and display our products accurately, but we do not warrant that descriptions, images, colours, specifications or other content are error-free, complete or current. Products are subject to availability and we may change or discontinue them at any time without notice.

Vehicle fitment and compatibility information is provided as a general guide only. You are responsible for confirming that a product suits your specific vehicle, variant and configuration before purchasing or fitting it.

4. Pricing

Prices are in Australian dollars (AUD) and include GST unless stated otherwise. Shipping is calculated at checkout. Prices, promotions and shipping charges may change at any time without notice.

Despite our reasonable efforts, pricing or product errors may occur. If we identify an error affecting an order you have placed, we may cancel that order (or the affected items) and refund any amount paid, before dispatch.

5. Orders & acceptance

Your order is an offer to purchase. Any order confirmation we send acknowledges that we have received your order; it is not acceptance of it. A contract is formed only when we dispatch the goods to you (or, for pre-orders, as described in clause 6).

We may decline or cancel any order at our discretion — for example, where we suspect fraud, where there has been an error, or where goods are unavailable. If we cancel an order you have paid for, we will refund the amount paid for the cancelled items.

6. Pre-orders & batch production

Some products are made to order in limited production batches. Where you place a pre-order or back-order:

  • any stated delivery window is a good-faith estimate only and is not a guarantee of a delivery date;
  • we will keep you updated and dispatch your item when its batch is ready;
  • any deposit, balance or payment arrangement will be shown to you at checkout before you pay; and
  • you may cancel a pre-order before dispatch in accordance with our then-current pre-order policy.

Nothing in this clause limits any right you have under the Australian Consumer Law, including where goods are not supplied within a reasonable time.

7. Payment

Payment is processed by our third-party payment provider. By placing an order you authorise us and our provider to charge your chosen payment method for the order total (or, for pre-orders, the amounts disclosed at checkout). We do not store complete card details.

8. Shipping & delivery

We ship within Australia. Delivery time frames are estimates only. To the extent permitted by law, we are not liable for delays caused by events outside our reasonable control, including courier or carrier delays.

You are responsible for providing accurate and complete delivery details. Risk in the goods passes to you on delivery.

9. Returns, refunds & your consumer rights

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. For a major failure with a product you are entitled to a replacement or refund, and to compensation for any other reasonably foreseeable loss or damage. For a failure that does not amount to a major failure, you are entitled to have the problem remedied within a reasonable time, and if this is not done, to a refund.

Beyond your rights under the Australian Consumer Law and any applicable manufacturer's warranty, returns — including for change of mind — are at our discretion and may be subject to conditions (for example, that items are unused and in original packaging and returned within a stated period). Custom-made or made-to-order items may not be eligible for change-of-mind returns. Please contact us before returning any product.

10. Warranties & disclaimer

Other than the consumer guarantees that apply under the Australian Consumer Law and any express warranty we provide in writing, and to the maximum extent permitted by law, we exclude all other warranties, conditions and representations, whether express or implied. The website and its content are provided on an "as is" and "as available" basis, and we do not warrant that the website will be uninterrupted, secure or error-free.

11. Limitation of liability

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy you have under the Australian Consumer Law or any other law that cannot lawfully be excluded.

Subject to the paragraph above, and to the maximum extent permitted by law: (a) we are not liable for any indirect, incidental, special or consequential loss, or for any loss of profit, revenue, data or goodwill, arising in connection with the website or our products; and (b) our total aggregate liability in connection with any product is limited, at our option, to replacing or repairing the product, supplying an equivalent product, or refunding the amount you paid for it.

12. Indemnity

To the extent permitted by law, you agree to indemnify us against any claim, loss, damage or expense we suffer arising from your breach of these Terms or your misuse of the website or our products.

13. Intellectual property

All content on the website — including text, images, graphics, logos and design — is owned by or licensed to us and is protected by intellectual property laws. You may not copy, reproduce, modify, distribute or use any of it without our prior written permission.

14. Acceptable use

You must not use the website for any unlawful purpose, attempt to interfere with its operation or security, or use it to transmit any harmful, misleading or infringing material.

15. Third-party links & products

The website may contain links to, or products from, third parties. We are not responsible for third-party websites, content or products. Any manufacturer's warranty for a product is provided by, and is a matter between you and, the relevant manufacturer.

16. Privacy

We handle personal information in accordance with our Privacy Policy.

17. Changes to these terms

We may amend these Terms at any time by publishing an updated version on this page. Your continued use of the website or placing of an order after changes take effect constitutes acceptance of the updated Terms.

18. Governing law

These Terms are governed by the laws of New South Wales, Australia. You submit to the non-exclusive jurisdiction of the courts of New South Wales and the Commonwealth of Australia.

19. General

If any provision of these Terms is found to be unenforceable, the remaining provisions continue in full force. Our failure to enforce any provision is not a waiver of it. These Terms, together with any policies referred to in them, form the entire agreement between you and us about their subject matter.
